The Thornbury Township Zoning Hearing Board held a public meeting on September 12, 2011 at 7:00 p.m. at the Township Administration Building, 6 Township Drive, Cheyney. to hear the appeal of Richard A Gabries from the July 27, 2011 Enforcement Notice citing violations of Section 27-402 arising from the operation of a business (es) at the property owned by Mr. Gabries located at 176 Dilworthtown Road, Thornton in the R-1 Residential Zoning District.
DECISION: Continued until November 7th.
Appeal No. 5-2011
The Thornbury Township Zoning Hearing Board held a public meeting on August 1, 2011 at 7:00 p.m. at the Township Administration Building, 6 Township Drive, Cheyney, Pa. to hear the appeal of John and Nancy Bragger for a variance from the terms of the Zoning Ordinance in order to construct a 2.5 story garage and an addition to the rear of their house which is located at 431 Thornton Rd., Cheyney, Pa.
DECISION: Granted the following variances:
- A variance from the l5% impervious coverage requirement of Section 403(3) to permit impervious coverage of 16.6%
- A variance from the front yard setback requirement of 85 feet, Section (403(4) in order to permit the construction of an addition to the rear of the Applicants’ house.
- A variance from the side yard set back requirement of 25 feet, Section 403(7) in order to permit the construction of a 2.5 story detached garage.
The variances are subject to the condition that:
- The applicants remove the existing garage;
- The new garage be located no closer than 22.5 feet from the side yard boundary line.
Appeal No. 4-2011
The Zoning Hearing Board held a public hearing at 7:00 p.m. on Monday, June 6, 2011 at the Township Building to consider the appeal of Christopher Minton for a variance from the requirements of Chapter 27, Section 1804,requiring a minimum rear yard setback of 25 feet in order to construct an expansion of the deck and roof over the top of the existing deck. The property is located at 44 Cherrydale Road, Glen Mills in the PRD-2 Residential Zoning District.
DECISION:
Approved the minimum extension of the deck to square it off from zero to 3-1/2 feet of the deck and to build the roof per the plan given to us in the application of June 6, 2011.
Appeal No. 3-2011
The Thornbury Township Zoning Hearing Board held a public meeting on May 2, 2011 at 7:00 p.m. at the Township Administration Building, to hear the appeal of Carl & Eloise Wisneski, who have an Agreement of Sale to purchase the home located at 11 Lovalee Lane, Thornton in the R-l Residential Zoning District. They appealed for a special exception to construct a 1700 sq. ft. in-law addition to be used as a separate dwelling unit to the existing single family home.
DECISION:
Mr. Cannon made a motion to grant approval of a special exception per Chapter 27, Section 2108, which is the section under conversion of a dwelling to a two-family use, with the condition that this must be only an “addition” to the existing structure and that it must be “attached” and that any present and future use of this space must only be used by a family member of the owner of the property. Mr. Morley seconded the motion. All members unanimously approved.
Appeal No. 2-2011
The Zoning Hearing Hearing Board held a public meeting on April 4, 2011 to hear the appeal of Michael and Tammy Tursi for a variance from the requirements of Chapter 27 Section 503 (3) & (4) of the Township Zoning Ordinance in order to construct a two story 500 sq. ft. addition and a 496 sq. ft. deck on their property at 14 Lake Drive (Brinton Lake Colony) Thornton.
DECISION:
The Board unanimously approved to grant a variance permitting them to construct an addition such that the impervious coverage on their lot does not exceed 20% of the total lot area and the addition must be at least 28 feet from the front yard boundary line.
Appeal No.1-2011
A hearing was held on February 7, 2011 to hear the appeal of Sean Kennedy. At that hearing, the ZHB allowed Mr. Kennedy to continue the hearing on March 7, 2011.
The Zoning Hearing Board received confirmation from Mr. Kennedy's attorney that he is withdrawing his appeal.
